1. Acceptance and eligibility
These Terms of Service (“Terms”) govern your use of the TourLore mobile app and the website at tourlore.co (together, the “Service”), operated by Luis Otávio Martins, a sole proprietor (MEI, CNPJ 40.822.339/0001-98) based in Sorocaba, São Paulo, Brazil (“TourLore”, “we”, “us”).
By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you don't agree, don't use the Service. You must be at least 16 years old to use TourLore.
2. The Service
TourLore uses artificial intelligence to help you plan walking tours and trips in cities around the world, narrate stops as audio, answer questions about what you're seeing, and keep tours available offline. We may add, change, or remove features over time.
3. Your account
You sign in with a third-party account (currently Google). You're responsible for keeping access to that account secure and for activity on your TourLore account. Tell us promptly at founder@tourlore.co if you suspect unauthorised use. One person per account; don't share or transfer it.
4. Safety while walking
TourLore is a guide, not a navigation or safety tool. Please:
- stay aware of your surroundings, traffic, and other people — don't look at your phone while crossing streets;
- follow local laws, signs, and rules, and respect private property, places of worship, and restricted areas;
- check opening hours, prices, access, and routes yourself — AI-generated content may be outdated or inaccurate;
- use your own judgement about which areas and routes are safe for you, especially at night.
You are responsible for your own safety and conduct while using TourLore.
5. AI-generated content
Tours, narration, and answers are generated automatically by AI and may contain errors, omissions, or outdated information about places, history, and practical details. They are provided for information and entertainment, and are not professional (legal, medical, financial, or travel-safety) advice.
6. Acceptable use
You agree not to:
- use the Service for anything unlawful, harmful, or abusive, or to harass, endanger, or infringe the rights of others;
- upload photos or content you don't have the right to share, or that is illegal, sexually explicit, or depicts others in a way that violates their privacy;
- try to bypass usage limits, reverse engineer, scrape, or overload the Service, or access it through automated means;
- resell, redistribute, or commercially exploit the Service or its content without our written permission.
7. Your content
You keep ownership of the messages, photos, and voice recordings you send (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, process, and transmit Your Content only as needed to operate and improve the Service for you, as described in our Privacy Policy. This licence ends when Your Content is deleted from our systems.
8. Our intellectual property
The Service, including the app, website, design, brand, and software, belongs to TourLore and its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for personal, non-commercial use. Tours generated for you may be used for your own personal purposes, such as sharing them with friends.
9. Plans, trials, usage, and payments
Creating tours, chatting with the guide, asking photo questions, and using voice input require an active plan (or free trial). Purchases are made through the Apple App Store or Google Play and are processed under their terms. Prices are shown in the store before you buy and may vary by country.
- Plans. We offer a Trip Pass and monthly and annual subscriptions. The Trip Pass is a one-time purchase that gives access for a fixed period shown before you buy (currently 7 days) and does not renew automatically. Monthly and annual subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before renewal in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
- Usage allowance. Every plan includes a usage allowance. Tours, chat messages, photo questions, and voice input all draw from it, each according to its estimated cost, and the app shows how much you have left. A Trip Pass's allowance covers the whole pass; monthly and annual plans get a new allowance each month. Unused allowance does not carry over to the next month or pass and has no cash value.
- When your allowance runs out, you can't create or re-plan tours, chat, ask photo questions, or use voice input until it renews, unless you buy a top-up pack or change your plan. Tours you already have stay available, and you can keep playing their narration.
- Fair use. To protect the Service, we also apply short-term limits (for example, per hour or per day) that may briefly pause these features even if you still have allowance left.
- Free trial. If a free trial is offered, you will be charged when it ends unless you cancel before then. The trial length and terms are shown before you start. A trial may include a smaller usage allowance; the plan's full allowance starts when the paid period begins.
- Top-up packs are one-time purchases that add usage credit to your account. Your plan's allowance is used first, then your top-up credit. Top-up credit does not expire and carries over from one period to the next, but it can only be used while you have an active plan: if your plan ends, your remaining credit stays on your account, dormant, and becomes usable again when you buy a new plan. Top-up credit has no cash value, can't be transferred, and is deleted if you delete your account.
- When a plan ends, you keep the tours you created and can still play their narration; creating or re-planning tours, chatting, asking photo questions, and using voice input need an active plan.
- Refunds are handled by Apple or Google under their refund policies, without prejudice to any mandatory consumer rights you have (for example, rights of withdrawal under applicable law).
- We may change prices, allowances, or plans for future periods; we'll give you advance notice and you can cancel before the change applies.
10. Third-party services and data
The Service relies on third-party services and data — including Google, OpenStreetMap contributors (via OpenFreeMap), and Wikipedia / Wikidata — and may link to apps such as Apple Maps or Google Maps. Their content and services are governed by their own terms; we aren't responsible for them. Map data © OpenStreetMap contributors.
11. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We don't guarantee that any place will be open, accessible, or as described.
12. Limitation of liability
To the extent permitted by law, TourLore is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or opportunities, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim (or BRL 100 / EUR 20 if you paid nothing).
Nothing in these Terms limits liability that cannot be limited by law, or affects mandatory rights you have as a consumer — including under the Brazilian Consumer Protection Code (CDC) or the consumer laws of the country where you live.
13. Suspension and termination
You can stop using TourLore and request account deletion at any time (see the Privacy Policy). We may suspend or terminate your access if you seriously or repeatedly breach these Terms, if required by law, or to protect users or the Service. Where reasonable, we'll notify you first. If we discontinue the Service, we'll give reasonable notice.
14. Changes to these Terms
We may update these Terms. We'll change the “Last updated” date above, and for material changes we'll notify you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Federative Republic of Brazil. Disputes will be resolved by the courts of the District of Sorocaba, State of São Paulo, Brazil. If you are a consumer, you may also bring proceedings in the courts of your place of residence, and you keep the protection of any mandatory provisions of the law of the country where you live.
Before going to court, please contact us at founder@tourlore.co — most problems can be solved quickly.
16. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours to a successor of the Service with notice to you. These Terms are available in English and Portuguese; if the versions differ, the English version prevails, except where the law requires otherwise.
